1. General Terms and Conditions of Sale of the Products on boutiquedelapatrouilledefrance.fr

It is specified in advance that these conditions exclusively govern sales by Expendo Organisation (registered office: 1 Rue Maryse Bastié, 18110 Pigny) for Patrouille de France, for textile products, sports equipment, accessories and souvenirs.
Article No. 1 - Price
1.1 - The prices of our products are indicated in euros, all taxes included (VAT + other taxes and in particular tax on video recordings, eco-tax, etc.) excluding a share in processing and shipping costs (see shipping costs).
1.2 - In the event of an order to a country other than mainland France, you are the importer of the product(s) concerned. For all products shipped outside the European Union and French overseas departments and territories, the price will be automatically calculated excluding tax on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and sums are not the responsibility of the Patrouille de France Boutique. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and/or competent bodies in your country. We advise you to check with your local authorities about these aspects.
1.3 - The Patrouille de France Boutique reserves the right to modify its prices at any time but the products will be invoiced on the basis of the prices in force at the time of your order validation.
1.4 - The products remain the property of Expendo Organisation until full payment of the price. We would like to remind you that when you take physical possession of the ordered products, the risk of loss or damage to the products will be transferred.
1.5 - The Patrouille de France Boutique is not intended to to offer sales to to professionals; the products and services sold by the Patrouille de France Boutique are mainly reserved for individuals.

The contractual information is provided in French and will be the subject of a confirmation containing this contractual information, at the latest at the time of your order validation.
Article No. 3 - Validation of your order
You state that you have read and accepted these General Terms and Conditions of Sale before placing your order. The validation of your order therefore implies acceptance of these General Terms and Conditions of Sale.
A summary of your order information will be sent to you via the order confirmation email.
Article No. 4 - Availability
The Patrouille de France Boutique is a retailer and its intent is not to sell large quantities of the products offered. Consequently, the Patrouille de France Boutique reserves the right to refuse orders for the same product in large quantities and orders containing 11 identical items or more.
Our product offers are valid as long as they are visible on the site and within the limits of available stocks, excluding promotional deals mentioned as such on the sites. In the event of unavailability of a product after placing your order, we will inform you by email. Your order will be automatically cancelled and no bank charges will be made. For information, the debit only occurs at the time of shipment of the package.
Article No. 5 - Delivery
5.1 - General Information
The products are delivered to the delivery address you indicated during the ordering process.
The delivery time corresponds to:
- the shipping time indicated on the Item form, to which is added
- processing and shipment time
In the event of delivery by a carrier requiring an appointment with the customer, the latter will contact you as soon as possible to agree a delivery appointment with you, and 30 days at the latest from the date of your order validation. The Patrouille de France Boutique cannot be held responsible for late delivery due exclusively to the unavailability of the customer after several appointments have been made by the carrier.
When you order several products at the same time and they have different delivery times, the delivery time of the order is based on the latest delivery time. However, the Patrouille de France Boutique reserves the right to split shipments. The contribution to the processing and shipping costs will only be charged for one shipment.
In case of delay in a shipment, an email will be sent to you to inform you of the possible impact on the delivery time that has been indicated to you. In case of late delivery, we will suggest a new delivery time by email.
In any event, in accordance with legal provisions, in the event of late delivery you have the right to terminate the contract under the terms and conditions defined in Article L 138-2 of the Consumer Code. In this case, if you have received the product, after your cancellation, we will refund the product and the "one-way" fees under the conditions of Article L 138-3 of the Consumer Code.
We also invite you to regularly track your order and contact Customer Service if you have any questions or problems. We provide you with a statement in the order confirmation email that you will receive after confirming your order, and which can be accessed in your "My Account" page; for this purpose, you just need to identify yourself using your email address and your password.
In the case of payment by credit card or private card and split deliveries, only the shipped products are debited.
We remind you that when you (or a third party designated by you) take physical possession of the ordered products, the risk of loss or damage to the products will be transferred.
5.2 - Reserves
You must notify the carrier and the Patrouille de France Boutique of any reservations about the product delivered (for example: damaged package, already opened, etc.).
Article No. 6 - Payment
We remind you that the fact of validating your order implies the obligation for you to pay the indicated price. Payment for your purchases can be made using the payment methods accepted by the Patrouille de France Boutique indicated in the "Payment methods" section.
The card is only debited when the order is shipped.
Article 7 - Security
Our site is subject to a security system.
We have adopted an encryption process, but we have also strengthened all scrambling and encryption processes to protect all sensitive data related to payment methods as effectively as possible.
Article No. 8 - Right of withdrawal
8.1 - Legal time limit for the right of withdrawal
In accordance with the legal provisions in force, you have a period of 14 days from the receipt of your products to exercise your right of withdrawal without having to justify your reasons or pay any penalty. After notification of your decision to exercise your right of withdrawal within this 14-day period, you have another 2-day period to return the product(s) pertaining to the withdrawal. After this period, no retraction will be taken into consideration.
8.2 - Contractual withdrawal period
At boutiquedelapatrouilledefrance.fr (products sold and shipped by Expendo Organisation), we offer you the option to exercise your right of withdrawal within 14 days of receipt of the products. Then you have another 14 days from the communication of your withdrawal decision to return the product(s) concerned.
The procedures for exercising your right of withdrawal are specified in 8.3.
8.3 Conditions for exercising the right of withdrawal
In the event exercising your right of withdrawal within the period referred to in 8.2, only the price of the product(s) purchased will be refunded; the return costs remain at your expense.
Returned products must be in their original and complete condition (packaging, accessories, instructions, etc.) allowing them to be re-sold in a new condition and, if possible, accompanied by a copy of the purchase invoice for optimal management of the process. In the event of depreciation of the product resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the product, you may be held liable.
To exercise your right of withdrawal, in accordance with the legal provisions, you will find attached in Annex 2 the standard withdrawal form to be sent to us at the following address: Expendo Organisation, 1 Rue Maryse Bastié, Patrouille de France Boutique, 18110 Pigny, France. You can exercise your right of withdrawal by any means and specifically by post or e-mail clearly expressing your intention to withdraw and mentioning the order number pertaining to this withdrawal.
Once the withdrawal form or declaration has been sent no later than 14 days after receipt of your order, you must return the product(s) concerned within a reasonable time and, at the latest, within 14 days of sending the form or declaration of withdrawal.
8.4 - Products excluded from the right of withdrawal
In accordance with the regulations in force, the right of withdrawal may not be exercised for products within the delicatessen and gastronomy category, which may not be returned for reasons of hygiene or health protection.

8.6 - Refunds
In the event of exercising the right of withdrawal, the Patrouille de France Boutique will refund the sums paid (including one-way delivery charges) at the latest within 30 days from the date on which the Patrouille de France Boutique is informed of your decision to withdraw and in accordance with the same payment method used for the order (unless you expressly agree to a refund using another payment method). This refund date may be deferred until the product is recovered or until you have provided proof of shipment of the product, whichever comes first. The Patrouille de France is not required to reimburse you for the costs generated by the return shipping costs. These costs remain your sole and entire responsibility.
It is however specified that in the event of total or partial payment by gift vouchers, they cannot be refunded either in cash, by cheque or by credit card. The reimbursement of purchases made by gift vouchers will be made exclusively in the form of gift vouchers for an amount identical to that paid in this form.
No cash on delivery will be accepted for any reason whatsoever.
Article No. 9 - Guarantees
9.1 - Product conformity
In accordance with the provisions of the legal guarantees of conformity and hidden defects (referred to in the box below and the texts of which are specified in Annex 1 of these terms and conditions), we will refund or exchange products that are apparently defective or do not match your order. If you are requesting a refund, please contact us on the number indicated in the order confirmation email that can also be accessed in your "My Account" page; to do so, simply identify yourself using your email address and password.
The products must be returned or brought back to us in packaging that allows them to be transported in a good condition. The shipping costs will be refunded to you on the basis of the invoiced rate and the return costs will be refunded to you upon presentation of supporting documents.
Please note that under the legal guarantee of conformity, the consumer:
- has a period of two years from the delivery of the property to take action against the seller;
- may choose between repairing or replacing the goods, subject to the cost conditions provided for in Article L. 211-9 of the Consumer Code;
- is exempted from providing proof of the existence of the lack of conformity of the goods during the six months following delivery of the goods. This period is extended to 24 months from 18 March 2016, except for second-hand goods.
The legal warranty of conformity applies independently of the commercial warranty that may cover your goods. It should be noted that the consumer may decide to implement the guarantee against hidden defects of the item sold within the meaning of Article 1641 of the Civil Code and that in this case, he may choose between the cancellation of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.
The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 8.

11.1 - All texts, comments, works, illustrations, works and images reproduced or represented on the boutiquedelapatrouilledefrance.fr website are strictly reserved under copyright and intellectual property law on a worldwide basis. As such and in accordance with the provisions of the Intellectual Property Code, only use for private purposes is authorised, subject to different or even more restrictive provisions of the Intellectual Property Code. Any reproduction or representation, in whole or in part, of the Boutique de la Patrouille de France website or of all or part of the elements found on the boutiquedelapatrouilledefrance.fr website is strictly prohibited.
11.2 - The corporate names, trademarks and distinguishing features reproduced on the boutiquedelapatrouilledefrance.fr website are protected under trademark law. The reproduction or representation of all or part of one of the above-mentioned distinguishing features is strictly prohibited and must be subject to prior written authorisation by the trademark owner.
Article No. 12 - Responsibility
The products offered comply with current French legislation. The Patrouille de France Boutique cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered (for example, in the event of a ban on a title or a product). It is your responsibility to check with local authorities about the possibilities of importing or using the products or services you plan to order.
The photos are provided for illustrative purposes. We politely request that you refer to the description of each product to find information about its precise characteristics; in case of doubt or if you wish to receive additional information, please do not hesitate to contact us on +33 (0)2 48 70 70 40 40.
In the event of purchases on a professional basis, boutiquedelapatrouilledefrance.fr shall not be liable for any indirect damages resulting from this contract, operating loss, loss of profit, loss of opportunity, damage or expenses, which may arise from the purchase of the products. We politely remind you that it is a good idea to backup the data contained in the products purchased. The Patrouille de France Boutique cannot be held responsible for any loss of data, files or damage defined in the previous paragraph. Total or partial inability to use the products, in particular because of incompatibility of equipment, may not give rise to any compensation or refund or liability on the part of of the Patrouille de France Boutique.
Our products provide a level of performance compatible with professional use even if the intent of the PAF Boutique is not to sell to professionals. The Patrouille de France Boutique cannot therefore be held liable for any damage whatsoever resulting from a professional activity. Similarly, the PAF Boutique cannot under any circumstances be held liable for any damage resulting from improper use of the device by the customer.
Article No. 13 - Applicable law – Disputes – Complaints handling – Mediation
This contract is subject to French law. The language of this contract is the French language. If you would like to make a complaint, please contact customer services at the following address – 1 Rue Maryse Bastié, Boutique de la Patrouille de France, 18110 Pigny, France.
You can use the mediation service for consumer disputes related to a purchase made on boutiquedelapatrouilledefrance.fr. In accordance with the rules applicable to mediation, any consumer dispute must be submitted in writing in advance before any request for mediation can be made.
In the event of a dispute, the French courts shall have sole jurisdiction.
Article n° 14 - Personal data
The personal information and personal data concerning you are necessary for the management of your order and our commercial relations. They may be forwarded to companies that contribute to these relationships, such as those responsible for the execution of services and orders in respect of their management, execution, processing and payment. This information and data is also stored for security purposes, to comply with legal and regulatory obligations and to enable us to improve and customise the services we offer you and the information we send you.
In accordance with the Data Protection Act of 6 January 1978, you have the right to access, rectify and oppose any personal data concerning you. All you have to do is write to us online at Customer Services or by post to Boutique de la Patrouille de France, 1 Rue Maryse Bastié, 18110 Pigny, France indicating your full name, e-mail address and if possible your customer reference. In accordance with the regulations in force, your request must be signed and accompanied by a photocopy of an identity document bearing your signature and must specify the address to which you want to receive the reply. A reply will then be sent to you within 2 months of receipt of the request.
Existence of an opposition list regarding telephone solicitation: If your telephone number is collected when you create your account or place your order, we inform you that your telephone number will only be used to process your orders or to contact you to offer you new services. Without prejudice to the above, in accordance with the legal provisions, you are informed that you may, if you wish, register on the list opposing telephone solicitation. You can register for free on this list, which is binding on all professionals except those with whom you have already concluded a contract.
Article L211-4 Consumer Code
The seller is obliged to deliver a product conformant to the contract and to answers defects of conformity which exist at the time of delivery. They must also responds to conformity defects resulting from the packaging, instructions for assembly or installation when these have been made their responsibility by the contract or have been produced under their responsibility.
Article L211-5 Consumer Code
To conform to the contract, the product must:
- Be suitable for the purpose usually associated with such a product and, if applicable:
- correspond to the description given by the seller and have the features that the seller presented to the buyer in the form of a sample or model
- have the qualities that a buyer can legitimately expect in view of public statements made by the seller, producer or his representative, in particular in terms of advertising or labelling
- Or have the features defined by mutual agreement between the parties or be suitable for any special requirement of the buyer which was made known to the seller and which the latter agreed to.
Article L211-12 Consumer Code
Action resulting from a lack of conformity is barred by limitation by two years from the delivery of the goods.
Article L. 211-16 Consumer Code:
When the buyer asks the seller to carry out repairs covered by his contractual guarantee, the period of any resultant shut-down of seven days or longer shall be added to the unexpired term of the guarantee. The said period shall run from the time when the buyer requests assistance or the time when the product in question is taken out of service pending repair, should this be subsequent to the request for assistance.
Article 1641 Civil Code
A seller is bound to a warranty on account of the latent defects of the thing sold which render it unfit for the use for which it was intended, or which so impair that use that the buyer would not have acquired it, or would only have given a lesser price for it, had he known of them.
Article 1648 paragraph 1 of the Civil Code
Action resulting from critical flaws must be initiated by the buyer within a period of two years following the discovery of the critical flaw.
